Loophole found in Immigration and Refugee Protection Regulations

I am replying to your e-mail of December 13, 2010, addressed to the Honourable Jason Kenney, Minister of Citizenship, Immigration and Multiculturalism, concerning the Immigration and Refugee Protection Regulations (IRPR).  I apologize for the delay in responding.

We would like to thank you for bringing to our attention the issue in relation to regulation 226(3) of the IRPR and its reference to section 81 of the Immigration and Refugee Protection Act (IRPA) to our attention.  In discussion between different branches within Citizenship and Immigration Canada, we determined that the error stems from changes made to IRPA. 

We will amend the regulation to more clearly illustrate the intent of the section with respect to the requirement for an authorization to return to Canada where section 81 of IRPA applies.
